Dear Mr Parsons,

 

I refer to your request for information under the Freedom of Information
(Scotland) Act 2002 (FOISA).

 

1.       How many people are employed to deal with FOI?

The Council does not have a team of dedicated officers to deal with FOISA
requests. The requests are processed by Customer Services Officers (CSOs),
and then many times passed to the relevant Services for the information.
Depending on the information which has been requested, this could be an
Officer, a Manager, a Head of Service, a Director, or any other member of
staff who holds or is able to extract and compile the information. The
Services then have the option to respond directly to the requester, or
send it back to their CSO, who will set the information into the right
format for a response.

 

The CSOs also deal with complaints and enquiries from members of the
public, elected members and other parties amongst other tasks. The amount
of time spent across these tasks varies in volume, and it is therefore
impossible to quantify how much is actually spent on FOISA. With this in
mind, please find the Council's response to your request. There is
currently one Freedom of Information/Data Protection Manager, and one
Freedom of Information/Data Protection Officer, but although these
individuals oversee the FOISA process they also carry out other duties
which are not FOISA-related.

 

2.       What is the budget for administering FOI?

There is no budget set aside for administering FOI, as dealing with FOISA
requests is built into a number of roles within the Council. Therefore,
under Section 17 of FOISA we are unable to disclose the information, as we
do not hold it.

 

3.       Do you use case management software for FOI? If so, which one?

We use Liberty CXM, which is a CRM system, to record contact made with the
Council, which include requests for services, FOISA requests, complaints,
etc. Our FOISA processes have been written around the system, and not the
other way around.

 

4.       Do you publish a disclosure log?

The Highland Council does not publish a disclosure log.

 

Under Section 20 of the Freedom of Information (Scotland) Act 2002, you
have the right to request that the Highland Council reviews any aspect of
how it has dealt with your request. This requirement for review should be
put in writing to the Freedom of Information Officer, Chief Executive’s
Office, Glenurquhart Road, Inverness IV3 5NX, within 40 working days of
receipt of this letter. The request should include details of the
information requested and the aspects of the Highland Council’s response
which you are not satisfied with.

 

If you are subsequently dissatisfied with the outcome of the Council's
review, you have the right to appeal to the Scottish Information
Commissioner under Section 47 of the Act (Regulation 17 of the EIRS),
within six months of receiving the Council's review response.
